Who is responsible for your data
Oscar Garza, a sole proprietor (an individual engaged in business activities) operating under the trade name “Tu Amigo el Mercadólogo,” domiciled in Monterrey, Nuevo León, Mexico (hereinafter, “the Data Controller”), is responsible for the processing of your personal data in accordance with the LFPDPPP (Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties) and other applicable regulations.

What data we collect
We collect data you provide directly (forms, purchases, course enrollment, email) and data obtained automatically when you browse the site:
- Identification and contact: name, email, phone number (if you share it), company, and website.
- Information about your business that you share voluntarily during the diagnosis or while a service is provided: your marketing situation, budget, metrics, and access to the platforms you choose to grant.
- Purchase data: products purchased, amounts, date, order number, and billing address.
- Tax data, only if you request an invoice: RFC (Mexican taxpayer ID), name or legal business name, tax regime, tax postal code, and CFDI use (Mexican electronic invoice).
- Course data: student account, progress, activity responses, and certificates issued.
- Browsing data: IP address, device and browser type, pages visited, and cookies (see the Cookie policy).
- How you use the site: clicks, scrolling, and movements within pages, recorded without your name or contact details (see “Session recording and heatmaps”).
- Chat conversations: the messages you write and whatever you choose to share there, such as your name, email, or links to your social media profiles (see “Site chat and AI assistant”).
We do not collect sensitive personal data. Your card details are captured directly by the payment processor (Stripe or PayPal); this site neither receives nor stores them.
How we use your data
Necessary purposes for your relationship with us:
- Replying to your messages and scheduling the diagnosis call.
- Quoting, contracting, and providing marketing advisory and execution services.
- Processing purchases, delivering digital products, and granting access to courses.
- Issuing invoices and complying with tax and legal obligations.
- Providing support, handling clarification requests, and managing refunds.
Additional purposes, which are not necessary for the above:
- Sending you content, news, and offers about products, courses, and services.
- Measuring site usage and campaign effectiveness, and detecting where browsing gets difficult in order to improve the site.
- Showing you related advertising on third-party platforms.
If you do not want us to use your data for the additional purposes, email us at [email protected] or use the “unsubscribe” link included in every email. Declining does not affect your purchases or the services you have contracted.
Who we share your data with
To operate the site, we rely on providers that process data on our behalf and under our instructions:
- Stripe and PayPal — payment processing.
- HostGator — hosting for the site and the database (including the CRM, FluentCRM, which is hosted on our own server).
- Cloudflare — secure delivery of the site, protection against attacks, and storage of browsing logs and heatmaps.
- Amazon Web Services (Amazon SES) — sending the site’s emails.
- DeepSeek — the chat’s AI assistant: it processes the text of the questions you write, without your name, email, or phone number.
- Google (Google Analytics) and LinkedIn — measurement of visits and campaigns, as described in the Cookie policy.
Some of these providers are located outside Mexico; because they are processors acting on our behalf, your consent is not required for that communication of data. We do not sell your data. We will only share it with authorities when a law or an order from a competent authority requires it.
Your rights (ARCO) and how to exercise them
You have the right to Access your data, Rectify it, Cancel it, and Object to its use for specific purposes, as well as to revoke your consent and limit its use or disclosure.
To exercise them, send an email to [email protected] with: your name and a way for us to reply to you; an official ID (or, if you are acting on someone else’s behalf, the document proving your authority to represent them); a clear description of the data and the right you want to exercise; and any document that helps locate the data.
We will respond within a maximum of 20 business days from the date we receive your complete request and, if applicable, we will make it effective within the 15 business days following our response.
If you have an account on the site, you can also view and correct several of your details from My account.
Session recording and heatmaps
To improve the site, we record how it is browsed: clicks, scrolling, cursor movements, and changes to the page during the visit. With that, we build session replays and heatmaps that show us where something is unclear or doesn’t work.
What you type in forms is never recorded: it is masked in your own browser before being sent, as are chat messages and your order details. We do not store your IP address (only your approximate country), and the “My account” pages are not recorded. To tell visits apart, we use a random identifier stored in your browser that is not linked to your name or your email.
Recordings are deleted automatically as new ones come in, and the rest of these records are deleted within 400 days at the latest. They are processed for the additional purpose of measuring site usage.
If you don’t want your browsing to be recorded, turn it off in this browser: your preference is saved and your browsing won’t be recorded again. To turn it back on, open the site with ?ux_optin=1 at the end of the address. You can also object by emailing [email protected].
Site chat and AI assistant
The site chat stores your messages and whatever you choose to share there in order to reply to you and follow up. Oscar reads every conversation. If you are logged in, the chat checks which resources you purchased so it can show you the guidance for those resources.
The questions you write in the chat may be processed by an external artificial intelligence provider (DeepSeek, with servers outside Mexico) to give you an automatic answer based on our material. Your name, email, phone number, and links are removed before they are sent.
If you’d rather have a person answer you, use the chat’s “Talk to Oscar” button: from that moment on, your messages no longer go through the assistant.
Cookies and similar technologies
This site uses first-party and third-party cookies to function and to measure visits and campaigns. What these cookies are, what they’re for, and how to disable them is explained in the Cookie policy.
Security
We apply reasonable administrative, technical, and physical measures to protect your data: an encrypted connection (HTTPS), restricted access to the site’s admin panel and the CRM, and certified payment providers. If a breach occurs that significantly affects your rights, we will inform you.
Changes to this notice
We may update this notice due to changes in the law, in our services, or in the providers we use. The current version will always be on this page, along with its update date. If the change is significant, we will also notify by email everyone who has an active relationship with us.
If you believe your right to the protection of your personal data has been violated, you may file a complaint with the competent data protection authority, in accordance with the LFPDPPP in force.
